Minor changes are being proposed to Policy A.R. 6.00.03 regarding the Importation of Inert Fill for the Purpose of Rehabilitation. The Policies and Procedures Manual is intended to assist Ministry of Natural Resources staff who are directly involved with the implementation and enforcement of the Aggregate Resources Act (ARA) and the regulations including the Aggregate Resources of Ontario Provincial Standards.
The current policy requires inert fill to meet criteria in Table 1 of Soil, Ground Water and Sediment Standards for Use under Part XV.1 of the Environment Protection Act.
The Ministry of Natural Resources (MNR) is proposing the following changes to Policy A.R. 6.00.03:
- To provide background information related to sodium adsorption ratio (SAR) and electrical conductivity (EC) related to soil quality standards of material being imported for rehabilitation.
- To amend the sample wording for site plan conditions in order to address the criteria under Table 1 for SAR and EC in situations where the imported material is not being placed within 1.5 m of the surface.
- To outline the method to be used to address existing site plan conditions that do not reflect the changes to this policy.
The Ministry of Natural Resources consulted with Ministry of the Environment and determined that the criteria, in Table 1, for sodium adsorption ratio (SAR) and electrical conductivity (EC) are for the purposes of ensuring adequate plant growth. Plant growth is affected by the conditions of the surface soil. Therefore, provided that the imported fill is being deposited more than 1.5 m below the surface, it is not necessary for the material to meet these two criteria.
Purpose of Policy:
To ensure that the public, agencies and stakeholders are aware of the proposed changes to Policy A.R. 6.00.03 and to provide an opportunity for comment.
