Site Plans are either approved by City Council or delegated to a specific staff member. Site Plan Approval (SPA) and Agreement is required prior to the issuance of a Building Permit for all development. SPA covers building placement, road access, transit, walkways, SWM, grading, landscaping, utilities, signage, parking layouts, etc. Once the Site Plan has been approved, a Site Plan Agreement must be submitted and registered on title. This Agreement contractually binds the owner to develop and maintain a site in accordance with the approved plans and the terms of the agreement. Site Plan Approval usually results in the approval of the Site Plan Agreement. The Agreement can be appealed to the OMB by the applicant only. Site Plan approval typically takes 9 to 12 months.
